Benclaire may collect the following personal data in the context of its B2B commercial relationships:

3. PURPOSE AND LEGAL BASIS FOR PROCESSING

  • Performance of a contract (Art. 6(1)(b) GDPR): order processing, invoicing, delivery and commercial communication.
  • Compliance with legal obligations (Art. 6(1)(c) GDPR): tax, accounting and regulatory obligations under Portuguese law.
  • Legitimate interests (Art. 6(1)(f) GDPR): commercial relationship management, fraud prevention and IT security.
  • Consent (Art. 6(1)(a) GDPR): sending marketing communications, where applicable and expressly authorised.

4. RETENTION PERIOD

Personal data is retained for the period strictly necessary to fulfil the purposes for which it was collected. As a general rule:

  • Invoicing and contract data: 10 years, as required by tax law (Art. 52 of the Portuguese VAT Code and applicable tax legislation);
  • Marketing data: until consent is withdrawn;
  • Other data: for the duration of the commercial relationship and, at most, 5 years after its termination.

5. SHARING DATA WITH THIRD PARTIES

Benclaire does not sell or transfer personal data to third parties for their own commercial purposes. Data may be shared, strictly to the extent necessary, with:

  • Carriers and logistics partners, for the purpose of order delivery;
  • Technology and IT service providers (sub-processors), who act under Benclaire’s instructions and are bound by data processing agreements compliant with the GDPR;
  • Public authorities, where required by law or court order.

Whenever data is transferred to countries outside the European Economic Area (EEA), Benclaire ensures that such transfers are carried out on the basis of appropriate legal mechanisms, in accordance with Chapter V of the GDPR.

  • Right to restriction of processing (Art. 18 GDPR): to restrict processing in certain circumstances;
  • Right to data portability (Art. 20 GDPR): to receive your data in a structured, machine-readable format;
  • Right to object (Art. 21 GDPR): to object to processing based on legitimate interests or for direct marketing purposes;
  • Right not to be subject to automated decision-making (Art. 22 GDPR).

If you believe that the processing of your data violates the GDPR, you have the right to lodge a complaint with the competent supervisory authority in Portugal: the Comissão Nacional de Proteção de Dados (CNPD), available at www.cnpd.pt.

7. DATA SECURITY

Benclaire adopts appropriate technical and organisational measures to protect personal data against unauthorised access, loss, destruction, alteration or disclosure, in accordance with Article 32 of the GDPR. These measures include, among others, access controls, encryption of data in transit and training of staff on data protection matters.
